Welcome to HealthMate AI. By using our mobile application (“App”), you agree to these Terms of Service (“Terms”). Please read them carefully.

1. Acceptance of Terms

By downloading, installing, or using HealthMate AI, you agree to be bound by these Terms. If you do not agree, do not use the App.

2. Description of Service

HealthMate AI is a personal health tracking application that provides:

• Health metric tracking (steps, heart rate, sleep, weight, nutrition)
• AI-powered food recognition via camera
• AI-generated personalized meal plans
• Integration with Apple HealthKit and Google Health Connect
• Health insights and wellness recommendations

3. Medical Disclaimer

IMPORTANT: HealthMate AI is NOT a medical device and does NOT provide medical advice.

• The App is intended for general wellness and informational purposes only
• AI-generated meal plans and health insights are not substitutes for professional medical advice, diagnosis, or treatment
• Always consult a qualified healthcare provider before making dietary changes, especially if you have medical conditions (diabetes, hypertension, kidney disease, etc.)
• Do not disregard professional medical advice or delay seeking it because of information provided by the App
• In case of a medical emergency, call your local emergency services immediately

By using the App, you acknowledge and agree that:

• You use health recommendations at your own risk
• We are not liable for any health outcomes resulting from following AI-generated recommendations
• The App's nutritional analysis is approximate and may not be 100% accurate

4. User Accounts

4.1 Account Creation

• You may use the App anonymously or create an account via Google Sign-In or Apple Sign-In
• You must provide accurate information when creating an account
• You are responsible for maintaining the security of your account

4.2 Anonymous Users

• Anonymous accounts are stored locally on your device
• If you uninstall the App without creating a full account, your data may be lost
• Anonymous accounts inactive for 12 months may be automatically deleted

4.3 Account Termination

• You may delete your account at any time through the App settings
• We may suspend or terminate accounts that violate these Terms

5. Acceptable Use

You agree NOT to:

• Use the App for any unlawful purpose
• Attempt to reverse engineer, decompile, or hack the App
• Upload malicious content or attempt to exploit the AI system
• Share your account credentials with others
• Use the App to generate harmful or misleading health advice for others
• Circumvent any usage limits or access controls

6. Subscription & Payments

6.1 Free Tier

• Basic features are available for free
• Free users receive limited AI meal plan generation (1 plan)

6.2 Premium Subscription (Coming Soon)

• Premium features and pricing will be announced in a future update
• Subscriptions will be processed through Apple App Store or Google Play Store
• Subscription terms will be governed by the respective store's policies

7. Intellectual Property

• The App, its design, code, AI models, and content are owned by HealthMate AI
• You retain ownership of your personal data and health information
• AI-generated meal plans and insights are provided for your personal use only
• You may not redistribute, sell, or commercially use AI-generated content from the App

8. Third-Party Services

The App integrates with third-party services:

9. Limitation of Liability

To the maximum extent permitted by law:

• The App is provided “AS IS” without warranties of any kind
• We do not guarantee the accuracy of AI-generated nutritional analysis or meal plans
• We are not liable for any direct, indirect, incidental, or consequential damages arising from your use of the App
• Our total liability shall not exceed the amount you paid for the App in the 12 months prior to the claim

10. Indemnification

You agree to indemnify and hold harmless HealthMate AI and its team from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

11. Changes to Terms

We may update these Terms from time to time. Significant changes will be communicated through the App. Your continued use after changes constitutes acceptance.

12. Governing Law

These Terms are governed by the laws of Vietnam. Any disputes shall be resolved in the courts of Ho Chi Minh City, Vietnam.

13. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
